[Insert Date] VIA OVERNIGHT MAIL [Insert Name/Mailing Address] Re: Cease and Desist Dear _________: Home Care Assistance (‘HCA”) has been notified of your significant and concerning violations of your employment agreement (“Agreement”) with HCA. Specifically, HCA is aware that you have accepted separate employment and are working directly with [insert client name] in violation of your agreement. As you are aware, your Agreement is clear that if you desire to work with a particular HCA client within three years following working for the client that you must pay HCA a $5,000 fee: (b) If Employee desires to work with a particular client other than in accordance with this Agreement at any time within THREE (3) years following the conclusion of Employee’s services for said client, Employee shall pay HCA a fee of FIVE THOUSAND DOLLARS ($5,000.00) prior to commencing any services for said client in consideration of HCA introducing the client to the Employee. Your misconduct is as a clear violation of your Agreement and HCA has no doubt it will be able to swiftly prove this should litigation be necessary. You are demanded to immediately cease and desist from working for [insert client name]. Alternatively, please contact me at (514) 907-5065 to discuss payment of the $5,000 fee. In the event you do not immediately cease and desist from the above actions, HCA will have no choice but to evaluate all legal options available, including potential legal action.
