Hi Tammi,

The attached declaration is for natural persons level 2 and 3 and for lenders natural persons. See below:


This declaration form (the “Declaration”) must be completed by every natural person disclosing any relationship with the enterprise (the “Applicant”) (Level 2 – L2) applying for authorization to enter into/renew a public contract/subcontract (the “Application”) or with one of its shareholders1 (Level 3 – L3).

The lender section is part 2, so if he's not a lender, he must sign where mentioned and complete part 3 only.

I'm helping Tim with the documents. We have a question about the attached Declaration of a Natural Person. We're not sure about the lender relationship. "This Declaration must also be completed by any natural person that is a Lender of the Applicant."

There are two stages in the AMP authorization process. The first takes between 2 and 3 weeks of processing by the AMP. As soon as the AMP agent confirms that the first stage has been processed by them, we can proceed to the second stage, i.e. disclosure of business links. The second step is verified by the AMP and then submitted by the Associate Commissionner of the Unité permanente anticorruption (« UPAC »). The treatment with AMP and UPAC takes between 4 and 6 weeks. Given your date of February 7, 2024, and the time required to process AMP, it would therefore be unrealistic to confirm that we would be able to obtain authorization in time.

Would the public body be willing to accept to move the deadline for submissions, given the delay in processing the application for authorization? In the meantime, we can put as much pressure as possible on the AMP to speed things up.
