Michaella is on vacation until October 13th. To obtain her validation of certain section of the law which the OQLF are interpreting their way. She may need about 1,5 hours of her time or less. I would like to get 2 sections validated to make sure we are on track with our arguments. We do not need to wait until she gets back to launch the program. First, I wish to apologies for the delay in providing you your first draft of the francization program. Although the proposition from the OQLF seemed somewhat reasonable at the first reading in comparison to other companies. The more we dug into it the more we started to realize that the OQLF was trying to impose the interpretation of the law to HCA with no exceptions where your services would be covered by exception. We needed more time to reevaluate our first draft, validate the law in your private sector so we can better educate the OQLF to do their job correctly and respectfully to each enterprise activities. Many of their propositions cannot be imposed to you and within my role of I cannot risk guiding you to commit of what may not be applicable. Therefore, you will see in the draft Francization Program proposal that we are making this clear and that we are committing to all that is possible and reasonable only. You will notice also that there are some sections that we will need your input.
Now regarding our Francization Committee meeting schedule for next Monday. Here are some options to consider :
1. If you are OK with sharing this type of information with all your members. We could use the meeting to go over this draft document so I can finalize it after to proceed for the signature via DocuSign so we will be able to submit as plan on October 4th.
2. I remove all notes, review this document with the Members, and answer their questions. Share that there will be a final version distributed with the pending answers incorporated which will be sent to all via DocuSign for signatures.
3. I will send a message to the OQLF on October 4th to let her know that we had our French Committee on October 2 and that our document is in the process for signature and that she will receive it by October 10th (which will give us a little more time to fine tune the Francization program on our end) and allow you to go on your vacation with a great peace of mind 😉
I will wait for your response before sharing the document with the FC Team.
Lastly, I would like to make a recommendation. As you know we are not attorney. I would like your permission to have the section about private sector (section 27 re. meeting notes) review by our legal team. Being your proxy signing this document, I want to be prepared for the response forthcoming from the OQLF so we have all the legal arguments ready to response back. In my opinion, the more ammunitions we have the easier it will be to ensure the OQLF will be reasonable within your context with your francization program.
