Yes, my assumption is that when I request payment to be made by a certain date, it’s going to occur. I requested payment be made by 1/31. I did not know until the following week that payment was not made. Going forward, so we avoid this, please reach out to AP for all payment status questions.

I have escalated it to both the VP of our relationship team as well as the individual responsible for all of our Letters of Credit.

 

I agree that this is taking much longer than it should. The delay is attributable to this being a new entity that had to by identified by the bank, having to establish new signer authorities with the bank for that entity, and this occurring over several holidays where the bank has been closed or in a "blackout" period where things slow down substantially.

 

I will continue to escalate with calls and emails to get this completed and as soon as I have the letter we will send it over.

We have discussed your situation with our Legal Services Branch. 

 

Unfortunately, under the security requirements as set out by the Employment Standards Act, 2000, the letter must be amended. 

 

Alternatively, the current letter can be cancelled, and you can choose to pursue a surety bond <https://www.ontario.ca/page/licensing-temporary-help-agencies-and-recruiters#section-4> . It is entirely up to your preference, but surety bonds generally have a faster turnaround when compared to the letters of credit.

We have reviewed your feedback with our issuing bank, JPMorgan Chase Bank, N.A. (Toronto Branch). The bank has indicated that removing the reference to “HCA Home Care Assistance Canada Inc.” would require Arya Healthy Living Inc. to undergo a full Know-Your-Client (KYC) process, which typically takes 4–6 weeks to complete and would substantially delay the licensing process.

The bank has confirmed that this structure does not change the legal or financial obligations under the Letter of Credit and that the Ministry remains the direct beneficiary with the same right to draw on the full CAD $25,000 amount. The wording simply reflects the administrative banking arrangement under which Arya Healthy Living Inc. operates its financial accounts through its parent company.

We would like to confirm whether the Ministry can accept this alternate wording, given that:

*       The ILOC remains irrevocable, unconditional, and payable on demand to the Ministry.

*       The amount, beneficiary, and enforceability are unchanged.

*       The inclusion of “for and on behalf of Arya Healthy Living Inc.” clearly identifies the applicant entity as the obligor.

If this wording cannot be accepted, we will proceed with initiating the KYC process for Arya Healthy Living Inc. to allow the bank to issue an amended ILOC fully in its name; however, we would appreciate confirmation to avoid unnecessary delays if the current structure is permissible.

Please let us know whether this version of the ILOC will satisfy the Ministry’s security requirements or if a new ILOC must be issued.

Tax Compliance Verification (TCV)

I have completed a TCV check using the Ministry of Finance's (MoF) online portal. The TCV check we conducted for 23-019689-TCV has returned a result of: Non-compliant. 
 

In my previous experience, this generally occurs because the applicant has not entered the TCV portal to upload an up-to-date Filling and Balance Confirmation (FBC) letter from the CRA showing that the legal entity is up to date on filing their returns and do not have any balances owed. However, the Ministry of Finance and the CRA are the ultimate authorities on this matter.
