Averaging agreement - We might need to amend the language to include a statement that shows the candidate is agreeable to it and space for initials. According to ESA, an employee must voluntarily agree to it. Is this being rolled out across Canada? Are we talking about the overtime section? - Yes, this came up in our Payroll Audit and they asked us to separate this from the employment agreement and get consent from employe= e. I will remove "Averaging Agreement" and add " OT to be paid according to E= SA" as per province regulation as a universal process. 2. Ontario addendum - Vacation pay - The default as per ESA is accrual. We can include verbiage and an option for the employee to choose between accrual and paid out per week. Since it is universal we need to choose only one option either accrual or pay out per week. What do we currently have in place across provinces? - In Ontario, the default option is accrual. If we need to pay it out per paycheck, we need to get consent f= rom the employee. I am not sure of other provinces. This issue came up in ou= r recent Payroll Audit from the Ministry of Labour In Canada it's based on accrual, If we decide to pay out every paycheck in future for Caregiv= ers then we can make changes after. 3. Can we add a section on Availability? Recruiters hire based on availabilities provided, and if there is a change, that impacts employability. We need staff to maintain availability during the probationary period and provide a two-week notice to change, contingent = on the new availability being conducive to the company. Could you please elaborate more on this one? Is this the same for other locations, provinces? - We don't have a protocol in place across Canada. For instance, we hire a caregiver with a daytime availability of 8AM to 4PM (Mon-Fri & alternate weekends). Should this caregiver change that availability once hired, the likelihood of continued employment with The= Key is minimal. Any material change in availability needs to be conducive to business operations. I ask that all hires maintain availability during probationary period and thereafter provide 2 week notice to change it. T= he Key standard is 90 days probation. This can be detailed on their offer letter and/or welcome package 4. Stat & Holiday pay - Is this missing from the agreement? The Stat and holiday information will be available in the handbook, however we can include how Stat & holiday pay is paid for caregivers if they work on a holiday.
