We had US counsel look at the HIPPA question as it relates to Lifeguard late last year .
As of now- with the current Lifeguard services it would not .
Something we should look at again - when the pilot is successful and we hopefully expand with THEKEY in the US.

Nicolas, an updated draft of the insurance application is attached. Can you please insert your information where applicable and recirculate to all? Once we submit to Kevin, we should attach the referenced Privacy Notice/Policy and Terms of Service.
Nat and Steve, please note that when I go to the Lifeguard website and click on "Privacy Policy", it takes me to the policy in a different language/not in English.
Also, as a reminder, while HIPAA does not currently apply to Lifeguard based on the current operations as described to us, as mentioned previously, as plans/services change (e.g., if Lifeguard begins to perform services on behalf of covered entity health care providers or health plans), it could meet the definition of a business associate under HIPAA and, therefore, be subject to HIPAA as it relates to business associates. It will be important to reassess HIPAA applicability as operations change and when submitting insurance renewals. The same goes for the California Consumer Privacy Act (CCPA).
