Thanks, Chuck ---------- Forwarded message --------- From: Mark Kolke Date: Tue, Mar 1, 2022 at 10:04 AM Subject: condition waiver issues - need your instructions today To: cterlesky@homecareassistance.com Chuck, An overview of where we are at: - condition waiver deadline was last Friday, and we got the landlord to agree to extend the waiver to March 2nd There are three scenarios to consider: 1. the first is to waive the conditions as they are, and the landlord says they will waive theirs in return; that will result in the landlord building the demising wall and installing a new kitchen as we had negotiated or 2. because the Landlord now sees substantial capital costs involved in that construction, they have proposed an alternative arrangement whereby they will forego a period of gross rent (rent and operating costs) for you to 'use the existing kitchen and otherwise stay on your side of the chalk line ... AND in that case, they will not build the wall, not build the new kitchen and keep the space empty to accommodate expansion as you need it or 3. since the landlord has played his hand, my thought is to negotiate a new deal for the entire space, ask them for two years of free rent and use the opportunity to negotiate a lower rent for taking a longer-term and still preserving your already negotiated renewal option Please give me your instructions ASAP so I can prepare the appropriate documentation. ALSO, since I've not heard any feedback from you, should I presume the most recent iteration of the Lease document is acceptable?
