I wanted to circle back to our conversat= ion about reporting suspicion of abuse to APS and your understanding that= a conviction had to be in place prior to a report. Please note: in Ill= inois, a licensed home services agency is required by law to report suspe= cted abuse, neglect, or exploitation immediately =E2=80=94 without waitin= g for a conviction. Under the Abuse of Adults with Disabilities Interven= tion Act and the Adult Protective Services Act (320 ILCS 20/4), any perso= n who suspects abuse, neglect, financial exploitation, or self-neglect of= an adult age 60+ or a disabled adult age 18-59 is mandated to report it = if they are in certain professions =E2=80=94 including home services agen= cy staff. The law specifically requires reporting upon reasonable suspici= on =E2=80=94 not upon confirmation or conviction. APS (Adult Protective S= ervices) investigates reports of suspected abuse. Their role is to determ= ine whether abuse occurred =E2=80=94 not to act only after a criminal con= viction. From the Adult Protective Services Act (320 ILCS 20/4): "= A mandated reporter having reasonable cause to believe that an eligible a= dult, because of abuse, neglect, or financial exploitation, is in need of= protective services shall make a report to the agency designated to rece= ive such reports." It is important to note that delaying reporting= for any reason is considered a violation of this law. Moving forward, = all suspicions of abuse, neglect, self-neglect, or financial exploitation= should be reported. If you are aware of any cases in which abuse, negl= ect, self-neglect, or financial exploitation has not been reported, pleas= e gather the details as soon as possible.
